ridgeline protection ordinance

Ridgelines are an important and unique resource within the City of Los Angeles. Recognizing the value of these resources, the City Council issued a Motion (Council File No. 11-1441-S1) instructing City Planning to identify ways to better protect and preserve the City’s ridgelines, which have become increasingly threatened by development activities. In response, Los Angeles City Planning has prepared the proposed Ridgeline Protection Ordinance.

The initial concepts for this proposed ordinance were shared at a community webinar on November 20, 2020. You can find the presentation from this webinar here.

The Ridgeline Protection Ordinance creates new setback, height, and grading restrictions in a buffer around the ridgeline. By way of example, any ridgeline covered by the ordinance requires that all points of structures be below 50 vertical and 50 horizontal foot window from the ridgeline.

In September 2020, Give Back, LLC sued Mohamed Hadid to enforce a personal guaranty that Hadid had previously given to secure a $25 million dollar loan. Hadid also pledged title to all of the land his related shell entities owned in Franklin Canyon Park as collateral. Hadid (and his shell entities) defaulted on the loan. On May 5, 2021, Give Back, LLC. obtained a judgment against Hadid in the amount of $26,387,498. Shown below are a few interesting documents filed in this case.

Hadid bankruptcy - January 15, 2021

On January 15, 2021, two of the Hadid shell entities that own land inside Franklin Canyon Park (i.e., Coldwater Development, LLC and Lyda Ludd, LLC) filed for Bankruptcy protection. These entities own considerable land under the Hastain Trail and importantly, also own the parcel at the plateau of the trail which is the site of the massive 75,000 square foot house planned for 9650 Royalton.

By way of the bankruptcy, we now know that in 2020 a company called “Give Back, LLC” acquired approximately $27 million dollars in debts owed by Hadid secured by the Franklin Canyon properties as collateral. More importantly, recent court documents reveal that Give Back intends to donate the properties to the State of California (potentially Santa Monica Mountains Conservancy) if acquired through foreclosure for public benefit. This is truly good news and bodes well for the potential permanent preservation of Franklin Canyon Park for public enjoyment.
